General / Scope

The following General Terms and Conditions shall apply exclusively to the business relationship between Best Pool Supplies Pty Ltd and its website (hereinafter: "Best Pool Supplies" or "the site") as well as our users, in the version applicable on the date of use. Best Pool Supplies does not recognise any terms and conditions set by the user that differ from these unless Best Pool Supplies has agreed to their validity in writing. The user acknowledges and agrees that Best Pool Supplies reserves the right, at its sole discretion, at any time, to change and, without prior notice, amend or delete any provision of these terms and conditions. Any such change, amendment and/or modification will become effective immediately when posted on our website. You are solely responsible for informing yourself of any such change by regularly checking any changes to these terms and conditions. Your continued right to use our services is subject to your compliance at all times with these terms, as amended or modified and in effect at each such time. Your rights hereunder, including to and under your account with Best Pool Supplies, are personal, and may not be used, shared or accessed by, or assigned or transferred to, any other person.

Ownership of the Content

The materials displayed on this site, including without limitation all information, text, materials, graphics, software, advertisements, names, logos and trademarks (if any) on this site ("Content") are protected by copyright, trade mark and other intellectual property laws unless expressly indicated otherwise. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this content in any way except as expressly authorised in writing by Best Pool Supplies. You may view this site using your web browser and save an electronic copy, or print out a copy, of parts of this web site solely for your own information, research or study, but only if you keep all Content intact and in the same form as presented on this site (including without limitation all copyright, trade mark and other proprietary notices and all advertisements). You must not use this site or the information on this site in any manner or for any purpose which is unlawful or in any manner which violates any right of Best Pool Supplies or which is prohibited by the General Conditions.

Promotions

Promotions presented by Best Pool Supplies shall only be valid if they are announced on the Best Pool Supplies website or by newsletter. Commentary and other materials posted on the Best Pool Supplies website are not intended to amount to advice on which any credibility can be placed. Best Pool Supplies disclaims to the fullest extent permitted by law all liability and responsibility arising from any reliance placed on such materials by any visitors to the Best Pool Supplies website or by anyone who may be informed of any of its contents.

Delivery

We ship goods either with Australia Post or courier. Delivery is 2–3 business days for major east coast capital cities and 5–6 business days for Perth. It may take 10 days or more for remote areas. Delivery time is calculated from the time goods are dispatched from our warehouse or our supplier's warehouse. We only ship within Australia.

Orders are dispatched from our warehouse in Yatala or directly from our supplier's warehouse and delivered by Australia Post or courier during normal business hours. A signature will be required on delivery. If you are not home to receive your parcel, a card will be left in your letterbox advising how to collect it during normal business hours. Parcels will be held by the delivery service for their maximum hold period. Should you not respond and the parcel is returned to us as unclaimed, further freight charges will apply for re-delivery. Freight charges paid for the original dispatch are not refundable. With this in mind, we recommend supplying a work delivery address wherever possible.

Please note that the above timeframes are a guide only as provided by our delivery carriers. Rural and remote addresses may take longer. Best Pool Supplies cannot guarantee exact delivery times and will not be liable for any delays, expenses or damages caused by carrier delays outside our control.

Customers must ensure they enter the correct delivery address at the time of ordering, or verify the details on the emailed receipt if the order is placed by phone. Best Pool Supplies is not obliged to re-send orders to a correct address at our expense where an incorrect address was provided.

If you order an item that is out of stock, we will notify you within 72 hours by email or phone. If for any reason we are unable to ship within 14 business days, we will notify you within that period.

Important Disclaimer

Best Pool Supplies recommends you seek on-site assistance from a qualified local pool professional prior to any purchase to find a suitable product for your pool. Due to the huge variety and complexity of pool systems and products, it is not possible for Best Pool Supplies to have full knowledge of your specific pool system. We cannot accept responsibility for merchandise that is not compatible with or does not function within your system. If in doubt, we recommend contacting the manufacturer directly before purchasing to confirm the product is suitable for your environment. All pool equipment should be installed by a qualified pool technician. The buyer assumes all responsibility outside of a manufacturer's stated return policy or warranty.

Return Policy

If you're not satisfied with your purchase, you can return it within 30 days of the purchase date for a refund.

• Contact us within 30 days of purchase to obtain a Return Authority Number (RAN) before sending anything back.
• Items must be unused, in original condition, and in original packaging. Returns not in original packaging may attract additional fees.
• Shipping costs are non-refundable. Return freight is at the customer's expense.
• Once we receive your return, refunds are processed within 5 business days.

Restocking Fees

A 20% restocking fee applies to most returns. The following exceptions apply:

• Above Ground Pools & Spas — flat $100 restocking fee
• Daisy Pool Covers — 20% if the cover has not been used on water; 40% if it has
• Daisy Rollers & Accessories — 15% restocking fee
• Bestway and MSpa Above Ground Pools & Spas where packaging has been opened and the pool set up — cannot be returned

For faulty, damaged or incorrectly supplied items, no restocking fee applies and return freight is covered by Best Pool Supplies.

Product Warranties

All products sold at Best Pool Supplies come with a manufacturer warranty. If you believe you have a defective product, please submit a warranty claim at www.bestpoolsupplies.com.au/warranty. Once received, we will contact you within 1 business day to assist. Where needed, we will lodge a warranty request with the manufacturer on your behalf and their aftersales team will be in contact to resolve the issue.

Best Pool Supplies does not express or imply any warranty. All warranties are the responsibility of the manufacturer. Best Pool Supplies expressly disclaims liability for any injury, loss, or damage of any kind arising from the use or inability to use any item we sell.

If an item must be returned to Best Pool Supplies, the manufacturer, or a warranty agent for servicing or replacement, the customer is responsible for all shipping, handling and transportation costs.

Protection of Data

The protection of your data is very important to us. We are committed to protecting your privacy and will only use information we collect about you lawfully.

We collect information about you for the following reasons: to process your order, to provide you with the best possible service, and to process warranty requests.

The information we collect includes your name, address, phone number, and email address. We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date — you can check what we hold by emailing us, and any inaccuracies will be corrected or deleted promptly. All personal information is held securely in accordance with our internal security policy and applicable law.

Australian law shall apply. To the extent legally permitted, the place of jurisdiction is New South Wales, Australia.
